I: Complainant’s Message to You
Dear Reader,
I, Charles Smith (the Complainant) am submitting this document for the purpose of providing a factual summary of Smith v. Prescription Plans. On May 11th, 2010, I filed an 8-page handwritten harassment claim with Samantha Mack (Human Resources Generalist) at Prescription Plans Inc. (PPI) in Building “B”. In retaliation, Samantha Mack dismissed my claim as “irrelevant”, “false” and “untruthful” on May 12th, discharged my employment without a proper investigation, and ordered that I be “escorted” off the premises by two Valley Heights police officers. This document will provide evidence that Samantha Mack’s retaliation is in direct violation with the State Human Rights Act and furthermore, is worthy of litigation in state court.
The following four events are in violation of the State Human Rights Act: 1) Between August 24th and September 12th, 2009, a pepper spray-like substance was sprayed above my cubicle. It caused me to have eye inflammation and severe headache. I reported the incident with Heather Bradley, Data Entry Supervisor for Medicine “A”, who claimed that she would report the event to the Human Resources (HR) department, but never submitted any documentation to HR, 2)Between September 28th and October 17th 2009, I met with Heather Bradley to remind her to file the report with HR about the previous incident, 3) Between November 2nd-14th, I reported the sexual harassment and hostile work environment conditions to Heather Bradley after I confronted two Lead Data Entry Technicians and another co-worker about the harassment. Heather Bradley assured me that a report would be filed with Human Resources and that disciplinary action would occur against workers who continued to exhibit hostile behaviors-that report never reached HR, and 4) On May 11th, 2010, I filed an 8-page handwritten harassment claim to Samantha Mack in HR and was discharged in retaliation on May 12th before 3:00pm.
