Chapter 4: The Binary Options Fraud

Empire

Binary options are a financial instrument where the buyer bets on whether an asset's price will be above or below a certain level at a specific time. If correct, they receive a fixed payout.

If wrong, they lose their entire investment. While this sounds like a simple bet, an entire criminal industry grew around binary options that defrauded victims of billions of dollars.

Israel became the global hub for binary options fraud, with hundreds of companies operating from offices in Tel Aviv, Herzliya, and Ramat Gan. At its peak, the industry was estimated to generate up to $10 billion annually, scamming millions of people worldwide.

Case Study: Yukom Communications

Lee Elbaz was the CEO of Yukom Communications, an Israel-based company that fraudulently sold binary options through two websites: BinaryBook and BigOption. In August 2019, after a three-week jury trial in Maryland, she was convicted of conspiracy to commit wire fraud and three counts of wire fraud. In December 2019, she was sentenced to 22 years in federal prison.

The scheme was elaborate and ruthless. According to court documents and trial evidence:

• Yukom's sales representatives used false names and fake qualifications when speaking to investors

• They falsely claimed to be working from London when they were actually in Israel

• They misrepresented the suitability and expected returns of investments

• They deceptively used "bonuses," "risk-free trades," and "insured trades" in ways that harmed investors

• They manipulated victims into depositing more money while making withdrawals nearly impossible

The total fraud was estimated at over $145 million, stolen from thousands of victims including retirees, veterans, and ordinary people who lost their entire savings.

How the Scam Worked

Victims were lured to BinaryBook and BigOption websites through aggressive online marketing, cold calls, and fake testimonials. The websites appeared professional and legitimate, with trading platforms that showed real-time price movements.

When victims deposited money, sales representatives would contact them posing as expert advisors. Using high-pressure tactics, they would convince victims to deposit more funds, often claiming that larger deposits would unlock better features or higher returns.

The trading platform was rigged. In many cases, the companies profited directly when customers lost money, creating an incentive to ensure customers failed. Representatives would encourage victims to make trades that were likely to lose, or the platform would manipulate prices to trigger losses.

When victims tried to withdraw funds, they faced endless obstacles: unexplained delays, requirements for additional documentation, claims that bonuses had to be traded a certain number of times first, or simply silence.

The Industry-Wide Crackdown

The Times of Israel's investigative reporting played a crucial role in exposing the binary options industry. Their English-language coverage pushed Israeli officials to take action. In October 2017, the Israeli parliament passed a law banning the binary options industry entirely, effective January 2018.

The FBI, working with Israeli police, launched extensive investigations. In January 2018, FBI agents raided the offices of SpotOption, a platform provider that supplied technology to hundreds of binary options companies. SpotOption claimed 70% market share and charged up to 12.5% of revenues from the companies using its platform.

In November 2019, a superseding indictment charged 15 individuals, including two former company owners, in a $140 million fraud scheme related to Yukom Communications.

Multiple defendants pleaded guilty and cooperated against Elbaz.

The crackdown sent shockwaves through the industry. Many companies closed overnight.

Some operators fled to other countries. Others rebranded as cryptocurrency or forex education companies, using the same tactics under new names.

LESSON: The binary options scandal shows how sophisticated and organized financial fraud can become. What appeared to be legitimate trading platforms were actually criminal enterprises designed to steal from customers. Always verify that any trading platform is regulated by a reputable authority.
