October 10, 2002: Michael Toney Legal Defense Fund Board Meeting Minutes The Secretary called the meeting to order at 7 PM. The Secretary stated the purpose of the meeting to close the organization's checking account at State National Bank of West Texas in Azle, Texas
After the purpose of the meeting was stated, the floor was opened for discussion. The Treasurer cited his reasons for the account's closure:
1. The bank's inability to handle foreign currency conversion exchanges.
2. Excessive fees.
3. Bank mishandling of check #616 to Attorney Randy Schaffer.
After a brief discussion the board voted unanimously to authorize the Treasurer, William A.
Davis to close the organization's bank account at State National Bank of West Texas in Azle, Texas.
The meeting adjourned at 730 PM.

October 15, 2002: Letter from Michael to Mr. Bill
I‘m not sure what is happening with the lawyer situation. I received a letter from him on Friday in which he told me that he received the 450.00 from you as well as 28,000 from France but the initial deposit was supposed to be 44,000. So, I‘m anxious to know what is happening with that.
He has sent a letter to Strickland requesting that all the prosecution notes, records, etc. be sent to them by FedEx but Strickland didn‘t have any of these documents because he never requested copies. The new lawyer will have to get his own copies. He thinks we will be going back into State court with issues that weren‘t raised by the court-appointed lawyers including ―ineffective assistance of counsel‖ regarding the trial and appellate lawyers.

Dear Mr. Bill:
I hope this letter reaches you and yours having a blessed day. As always I need your help with something and I hope you don‘t mind. Actually it‘s a couple of things. Still no word from Denise which has me worried sick. I already have a bad sense of the flu and a high fever but the stress sure isn‘t helping any.
First of all, I need to send an email to MB in France regarding the lawyer‘s money and about sending me some money. Tonight I received a letter informing me that 27,000 has been sent from the M‘AIM account to him on October 5th but the lawyer said he has only received 28,450
total so there is some confusion somewhere. There is some cash at the P.O. Box that is for me here and to pay my tuition but Denise seems to be out of service for the time being so I need some help with that. I need to buy some food, aspirin, cough syrup and stamps as soon as I can.
It‘s my writing that keeps the defense fund money coming in. When I stop it stops. If you haven‘t heard from Denise would you advance 100.00 to my account here and I‘ll get you reimbursed from France. If you can please send it by Western Union as I mentioned in a previous letter as soon as possible. I‘ve already missed this week‘s commissary but if the money gets here before Wednesday the 23rd, I‘ll be able to get what I need. (Mr. Bill: This was the first of several thousands of dollars that I sent by Western Union to Michael‘s inmate account.) I can‘t find M‘s direct email but she can also be emailed through the web site: michaelaim.org.

I was hoping to hear from you by now but…I haven‘t heard from you or Denise. She still hasn‘t paid my tuition nor has she sent me money to me for food and postage. She won‘t even answer me. I hope this letter reaches you having a good day. I received your letter tonight and I perfectly understand that you don‘t have time to do things for me. I didn‘t and don‘t have the right to ask in the first place. I just feel so damn helpless in this place and situation--its killing me from the inside out.
About the bank account--once again I understand. I‘m so pissed at S about that I can‘t stand it.
She didn‘t have any business asking you to send anyone a check. That money was obligated elsewhere. That‘s why the association they founded over there doesn‘t want anything do with her. She wants to be the boss of everybody but she doesn‘t raise a penny herself.
There is nothing I can do about it right now but Denise isn‘t being truthful. My tuition is two months behind and a lot of money is missing. I can‘t deal with that anymore. I feel like doing what that trash lawyer, Ford told me to do: ―Give the money to your daughter and take your punishment.‖ I don‘t know what I am being killed for but it seems it‘s a no win situation. I guess that would be the most responsible thing I can do.

Her heartfelt note convinced me to continue supporting Michael and I found the time to help him. I don‘t know why they trouble him in everything.

You really deserve a special ―thank you‖ to have sent the money so quickly to Michael. His situation over there is desperate. It‘s not his fault if he can‘t eat what they serve.
For the Western Union, two pen pals tried it and their money came back. The prison refused it! I wonder if it is only to worry Michael, like they have been doing for nearly 6 months now for everything.
In our association ―M‘AIM‖ (4 members) we think to try to send regular pocket money to Mike from now on. We had previously asked RC to do it, several times, but he never paid attention.
Here is the result! (Mr. Bill: From this point on, Madame CD regularly sent Michael‘s pocket money to me which I transferred by Western Union to his inmate account.) Well, thanks again. I wonder why Michael does not receive his courses, if they were paid…Is it the prison again??

She is no longer employed. I found out by a letter I sent to her at work. It was returned ―NO LONGER EMPLOYED.‖

On December 4th I wrote a long letter to you and T asked her to transmit it to you. It explained everything the lawyers said and more. In fact they are very concerned about it and the fact that they haven‘t received any news from anyone.
Maybe that has changed now. I hope. Basically they told me the only chance I have is to raise lots of money very fast for investigators and polygraph tests. They said everything the other lawyers did was TRASH and that they obviously didn‘t have my best interest in mind. They said the same about everything T has done thus far. They said it is worthless. Don‘t take my words wrong because I like the lawyers a lot. I appreciate their honesty. You must insist that T send you the letter I wrote to both of you. I still don‘t have any money so I had a pretty miserable Christmas and my birthday is today. Last time money was sent to T for me it took her 8 months to send it to me so you must stay in contact with her. If she doesn‘t answer you it is the same as she did S. She was ashamed. We may need different investigators. I wish you would have sent the money directly to the prison account via Western Union. Mister Bill could have told you how to do it. T is not being truthful. Another week has passed and she still hasn‘t sent the money. Last time we had this problem she made all kinds of excuses and she is doing it again. Hello Mister Bill:
Just a note to let you know I‘m still alive here in Fort Worth (Tarrant County Jail) and that I‘m OK. I expect to be taken back any day and it will be none too soon For security reasons they have me in an area with a lot of nut job suicidal people which in a way is torture. I‘m trying to live and keep from being murdered by my fellow inmates. These men have very minor legal troubles and act like they want to die. Other than that, they‘re treating me as well as possible. For two weeks I was in a cell in which the door wouldn‘t lock just like my cell on DR--that‘s your hard-earned tax dollars working for you.
Please tell M in France that I am OK and that I didn‘t bring any addresses with me. I‘ll write as soon as I can and that I send my love and kisses.

M, I haven‘t had any news from Denise at all and no I haven‘t received the books. I have sent many letters to her asking about them but she doesn‘t answer. Maybe she will answer you. I don‘t know.
My newspaper subscriptions have expired and I‘d like to renew them but only if they can be afforded. I know we must focus on the investigation etc. and I‘m not even certain how much the paper would cost. I‘d like to receive the Fort Worth Star-Telegram by mail. Maybe you can access their web site and check it out. If it‘s too expensive I will understand completely.
I spoke with my mother on the phone a couple of times while I was in the Tarrant County Jail and the first few times it wasn‘t good but then the strangest thing happened that made me realize what was wrong. She was telling me about her two little Chihuahua dogs and it made me laugh.
When I laughed I heard her sigh in relief. She needed to hear me laugh. Since I‘ve been back she sent me a nice letter and some photos of my nephew, Hunter. She has also talked with Tena.
Please tell Tim I will be writing soon. Also, I know you‘re very busy but I‘d like to have news from you.

I hope this reaches you having a good day. I‘m as well as can be expected, just a little discouraged lately. Thank you for sending me the money and the email. I was surprised to see that Denise gave you the info. I have a friend who will print and send you email for me if you will contact her and give her the info to access the Yahoo email account. Her name is Antoinette and her email is XXXX. I know you‘re too busy to receive and answer email for me.
In 1985 can you remember there being some sort of park immediately after the Lake Worth Bridge on 199 going toward Azle on the right? (Mr. Bill: My answer is ―No.‖) There was a park with a road that led back beside the lake to a metal gate. That‘s where I went fishing in December 1985 and January 1986. Was that the Fort Worth Nature Center? (Mr. Bill: The place Michael is referring to was private property. The Nature Center is approximately 2 miles past the Lake Worth Bridge on the way to Azle.) This is important because until many years later I didn‘t go beyond that point. The ATF think we went to the Nature Center which is somewhere past Hilltop Mobile Home Park but I‘ve never been there. I thought that park was the Nature Center and it may be now. That‘s why I asked about a map or a copy of an old map.

Thank you for the map. It‘s a big help but I‘m confused about something. Maybe, you‘ll know exactly where we were. I know we entered Sunset Park and went down the shore line to a metal gate. We stopped at a narrow slew right at the gate. On the other side of the gate was a dirt road.
Does that make sense? Is that shore line still accessible from Sunset Park? We never went beyond Love Circle on 199. Never! Where is Hilltop in comparison with these places?
